Joseph Daly is an Emeritus Professor of Law at Mitchell Hamline School of Law in St. Paul, Minnesota. He was the “Robins, Kaplan, Miller & Ciresi Distinguished Professor of Litigation Skills and International Dispute Resolution” at Hamline University School of Law. A Fulbright Scholar and a Fulbright Senior Specialist in ADR at the University of Montevideo, Uruguay for three years. A Visiting Professor at the University of Montevideo, Uruguay, South America where he teaches one-week intensive courses entitled  “Alternative Dispute Resolution and American Litigation” and “Resolving International Commerical Disputes by Arbitration.” He has been an Arbitrator and a Mediator since 1978.

Before becoming a law professor he was a trial lawyer and a partner in a Minneapolis law firm. His interest in Alternative Dispute Resolution (ADR) methods to resolve conflict developed when he saw the pain, anguish and cost involved in the litigation process. While he understands that at times litigation is absolutely necessary, he can still hear one of his clients cry out after “winning” a case in court, “There has to be a better way!” Professor Daly looks for that better way to resolve conflicts by understanding that negotiation, mediation and arbitration can be highly effective, efficient and affordable alternative dispute resolution methods. His work as an Arbitrator and a Mediator reflects his desire to provide “quick, efficient, economical and fair” methods of conflict resolution.

A highly respected practitioner and teacher and a sought-after Mediator and Arbitrator in civil rights, commercial, labor, employment, personal injury, court-ordered and insurance disputes. He has arbitrated and mediated more than 1000 cases. He was Director of the Employment Mediation Clinic at the law school.

Professor Daly has written books and articles on ADR, for examples: J. Daly, International Commercial Negotiation and Arbitration, 22 Hamline Journal of Public Law and Policy 217 (2001) and J. Daly, Arbitration: The Basics, 5:1 The Journal of American Arbitration (Penn State 2006). He is an arbitrator for the United States Federal Mediation and Conciliation Service (Washington, DC), has been a commercial arbitrator and a labor arbitrator for the American Arbitration Association (New York), and a labor arbitrator for the State of Minnesota Bureau of Mediation Services and a number of other states including Oregon, Wisconsin, and the Virgin Islands. A Mediator and Principal for Value Solve ADR, LLC and for Court Ordered Mediation cases. A Qualified Neutral under Rule 114 of the Minnesota General Rules of Practice and listed in the Minnesota State Court Rosters as provided for Ru114. Professor Daly is listed in Super Lawyers and Leading American Attorneys as one of the best ADR practitioners. A frequent lecturer on “ADR: Negotiation, Mediation and Arbitration” topics in the United States and in many countries such as Albania, Hungary, Poland, Azerbaijan, Thailand, Vietnam, Malaysia, Fiji, The Philippines, China, Australia, Norway, England, France, Uruguay, Argentina, Kenya, Cameroon and others.
